1. Acceptance of Terms

1.1 These Terms & Conditions (“Terms”) govern your use of the Hungersate mobile application, website, and related services (collectively, the “Service”) provided by Hungersate Online Food Services Private Limited. (“Hungersate,” “we,” or “us”).
1.2 By accessing or using the Service, or placing an order through the Service, you (“User”) agree to be bound by these Terms. If you do not agree, you must cease all use of the Service immediately.

2. Nature of Service

2.1 Hungersate operates as an intercity food logistics and fulfilment platform, enabling Users to discover, order, and receive packaged food products from selected restaurants and Vendors.
2.2 Hungersate does not manufacture, prepare, or produce any food products unless explicitly stated. All information regarding product quality, ingredients, allergens, and packaging is provided by the respective Vendors.

3. User Eligibility

3.1 The Service is available only to individuals who are at least eighteen (18) years old. By using the Service, you represent and warrant that you meet this age requirement.
3.2 Users must provide accurate, current, and complete registration and account information.
3.3 The Service must be used solely for lawful purposes in accordance with these Terms.
3.4 Hungersate reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Ordering and Fulfilment

4.1 All orders are subject to acceptance based on product and vendor availability and logistics feasibility.
4.2 Intercity deliveries may involve air or surface transport, and delivery timelines may be affected by factors beyond Hungersate’s control, including but not limited to airline operations, weather conditions, and unforeseen delays.
4.3 Hungersate shall not be liable for any delays or failures in delivery resulting from circumstances beyond its reasonable control.

5. Pricing and Payments

5.1 All prices displayed on the Service are inclusive of applicable taxes unless otherwise specified.
5.2 Payments must be made online using the payment methods supported by the Service.
5.3 Hungersate reserves the right to modify prices and impose delivery or handling charges at any time without prior notice.

6. Refunds, Returns, and Cancellations

6.1 Orders once confirmed cannot be cancelled due to the bespoke nature of intercity food fulfilment.
6.2 Refunds may be issued solely under the following circumstances, subject to verification by Hungersate’s support team:
 (a) Non-delivery due to operational failure attributable to Hungersate or its logistics partners;
 (b) Receipt of damaged or compromised goods, supported by photographic or other verifiable evidence;
 (c) Significant delays exceeding acceptable transit timelines caused by Hungersate or its logistics partners.
6.3 Approved refunds shall be processed to the original payment method within seven (7) to fourteen (14) business days from the date of approval.

7. Product Quality and Safety

7.1 Food products are prepared by Vendors and may not contain preservatives unless expressly indicated.
7.2 Hungersate provides temperature-controlled logistics where applicable but does not warrant sensory attributes such as taste, spiciness, sweetness, or texture, which may vary due to transportation.
7.3 Users are responsible for adhering to any storage and consumption instructions provided with the products.

8. User Obligations and Prohibited Conduct

8.1 Users agree not to:
 (a) Use the Service for fraudulent, unlawful, or unauthorized purposes;
 (b) Manipulate or falsify ratings, reviews, feedback, or other communications on the platform;
 (c) Attempt to disrupt, hack, scrape, reverse engineer, or otherwise compromise the Service or its systems.

9. Intellectual Property Rights

9.1 All intellectual property rights in the Service, including but not limited to trademarks, logos, designs, content, and software, are owned exclusively by Hungersate or its licensors.
9.2 Users shall not copy, reproduce, distribute, or otherwise use any intellectual property without prior written consent from Hungersate.

10. Limitation of Liability

10.1 To the fullest extent permitted by applicable law, Hungersate shall not be liable for:
 (a) Delays or failures in delivery beyond its control;
 (b) Vendor-related product quality issues;
 (c) Incorrect delivery addresses or other errors caused by Users;
 (d) Minor variations in product appearance, taste, texture, or packaging.
10.2 Hungersate’s maximum aggregate liability under or in connection with these Terms shall not exceed the total amount paid by the User for the relevant order.

11. Account Suspension and Termination

11.1 Hungersate reserves the right to suspend or terminate User accounts without prior notice for violations of these Terms, misuse of promotional codes, abusive conduct, or fraudulent activity.

12. Amendments to Terms

12.1 Hungersate may amend these Terms at any time by posting updated Terms on the Service.
12.2 Continued use of the Service after such changes constitutes acceptance of the amended Terms.

13. Governing Law and Jurisdiction

13.1 These Terms shall be governed by and construed in accordance with the laws of the Republic of India.
13.2 Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India.
